Judge Sides with County in Lawsuit Against Los Osos Wastewater Project



Los Osos, CA -- In a ruling Friday, a San Luis Obispo Superior Court Judge sided with the county in a lawsuit filed against the Los Osos Wastewater Project. The lawsuit, filed by Jiordana Stark of Los Osos, stated that the ordinance allowing the project involved a special tax to pay for the operation of the facility. Stark argued that these taxes invalidate the ordinance allowing the Wastewater Project because new taxes need to be voted on and approved by a two-thirds majority. The County of San Luis Obispo argued against the fact that the money to be collected from residents to operate the Wastewater Project was fees, not taxes. Judge Charles Crandall ruled Friday that the money in question could not be considered taxes, and were indeed fees as the county had argued. That ruling validated the ordinance and will not force any further vote on the issue.
