San Luis Obispo, CA -- Sunny Acres owner Dan DeVaul is due back in court Monday, where a judge could decide if he should be sent back to jail to finish his sentence related to code violations. In 2009, he was sentenced to 90 days in jail but filed a notice of appeal and was bailed out.

Last month he lost that appeal, so now it's up to a judge to decide what happens next. The district attorney's office did not want to comment on DeVaul's case.
